Terms and Conditions ticket purchases
The Blackburn Empire Theatre Limited does its best to ensure that all the information on this website is current and accurate.
In these terms and conditions the following words have the meanings set out below:
“Theatre” means The Blackburn Empire Theatre, Aqueduct Road Ewood Blackburn BB2 4HT.
“Contract” means any contract for the purchase of Tickets made between you and the Theatre.
“Tickets” means tickets offered for sale by the Theatre for attending live, staged performances of a theatrical, Dance, comedy, operatic nature or other offering. Each Ticket represents one seat.
2. Our Contract with You
2.1 These terms and conditions govern all audience ticket Contracts.
2.2 Your Contract with the Theatre will be concluded when you pay for the tickets either by cash, cheque, credit card or debit card or for group bookings on the issue of an invoice.
2.3 The prices and availability of the Tickets are advertised in different ways including but not exclusively, in the media, on fliers and on the Theatre’s website. These details are based on the best available information and the Theatre is not obliged to conclude any Contract on these terms. Concession rates only apply to productions where a concession ticket price is advertised. Concessions rates are available for children and adults aged 60 or over or as specified on the individual show.
2.4 Where a person makes a booking on behalf of a party, that person accepts these terms and conditions on behalf of all members of the party and is responsible for all payments due from the party.
2.5 Telephone Booking services with the Theatre are normally only available between 10am and 12:30 pm Monday to Saturday.
2.6 The Theatre reserves the right to place restrictions on the volume of any Tickets ordered.
2.7 It is your responsibility to check that the purchase of the tickets is accurate.
3. Terms of Payment
Tickets can not be reserved without payment in full by cash, cheque or Credit or Debit cards that are accepted by our machine service provider or via debit or credit card for online purchases.
Please note: the Theatre does not post out tickets. For bookings not made at the booking office, tickets will be available for collection at the office during normal opening hours of 10.00hrs and 12.30hrs Monday to Saturday or half an hour before the show commences. You can also opt to print your tickets at home.
5. Alterations and Cancellations
5.1 The Theatre does not normally permit tickets to be refunded after purchase. If a show is re-scheduled for any reason tickets purchased will be transferred to the new date. A re-scheduled show does not entitle you to a refund. All tickets for the annual Pantomime are also strictly non-refundable.
5.2 All Tickets are sold subject to the Theatre’s right to make any alterations in the cast or arrangements advertised on the Theatre’s website or elsewhere which are rendered necessary by an unavoidable cause.
5.3 Resale of tickets. You are not entitled to resell any tickets for more than the face value of the Ticket. For socially distanced shows, you cannot resell the tickets. If you purchase resale tickets from any party for a socially distanced event, you will be refused entry.
5.4 As a service to you, unwanted tickets can be returned to the box office and placed on re-sale but a refund will only be given in the event that the tickets are re-sold.
5.5 If a performance is cancelled, ticket holders will be offered a credit against tickets for an alternative performance (subject to availability) up to the seat value on the ticket or a refund.
It is your responsibility to ascertain whether an event has been cancelled or re-scheduled and the date and time of any re-scheduled event. Where an event is cancelled or re-scheduled, we will use our reasonable endeavours to notify you using the details you provided us with at the time of ordering. We do not guarantee that you will be informed of such cancellation before the date of the event. If you can’t make the new date you have until the date of the original event to claim a refund.
It is your responsibility to inform us of any change to the contact address, telephone number or email address you provide us with at the time of ordering. It is important that you ensure your email address is provided at booking and is accurate as this is our main method of communication with customers.
5.6 COVID -19
All attendees in your group, including yourself, must commit to stopping the spread of COVID-19. If at the time of the event, either you, or any other members of your group are feeling unwell or are subject to a self-quarantine or self-isolation period, you agree not to attend the event. If you do attend the event, you agree to assume all risk associated with COVID-19.
Admission to an event is at all times subject to these Terms, Conditions or rules of the Promoter and Venue Management. Ticket holder(s) must also adhere to the Promoter or Venue Management specific terms of entry and protocols surrounding Covid-19 – this could be, but is not limited to, an obligation to provide negative lateral flow tests or provide vaccination certificates. If you do not comply with any Promoter or Venue Management’s Terms, Conditions or rules then the Promoter and or Venue Management may refuse admission or require the ticket holder(s) to leave the venue and the ticket holder(s) will not be entitled to a refund.
Admission rules may change after you have purchased your tickets due to government regulation changes relating to COVID-19. You must comply with government regulations at the time of the performance, not at the time of order. Unless the changes to regulations stop you from physically attending the theatre, refunds will not be given following any change to government regulations after your order is placed.
What happens if I have Covid and can’t use my ticket?
For maximized confidence, customers who can no longer attend their event because of a positive Covid-19 result can exchange their tickets to a later performance prior to the event through their original ticket seller subject to availability. Refunds can only be considered if the customer added Booking Protect at the time of purchase. Booking Protect will process these claims, not the theatre. If the performance is cancelled, you will be contacted by your point of purchase and a full refund or exchange/voucher will be given.
6. Liabilities of the Theatre
6.1 Subject to Clause 6.3 below, the Theatre will only be liable to you for direct losses arising as a result of:
(i) a breach of these terms and conditions by the Theatre; and (ii) any fraudulent statement or negligent act by the Theatre arising under or in connection with the Contract.
6.2 The Theatre’s total liability under clause 6.1 above is limited to the total face value of the Tickets.
6.3 Nothing in this Clause 6 or these terms and conditions excludes or limits the liability of the Theatre for death or personal injury caused by the Theatre’s negligence or fraudulent misrepresentation.
6.4 The Theatre will not be liable in any way if an event or performance is abandoned after more than half of it has taken place due to any factors which are beyond the Theatre’s reasonable control. Without limiting the foregoing, the following shall be regarded as causes beyond the Theatre’s reasonable control:
(i) Acts of God, which include earthquakes, cyclones, storms, flooding, fire, disease, fog, snow or frost; (ii) Force Majeure which includes war, accidents, acts of public enemies, strikes, embargoes, perils of the air, local disputes and civil commotions; (iii) Power failure and failure of sound or lighting equipment.
7. Data Protection
The Theatre will collect, use and store your personal details in accordance with the Data Protection Act.
8. Entire Agreement
It is the intention of the Theatre that all terms of the Contract between the Theatre and you are contained in these terms and conditions. If you wish to rely on any variation of these terms, you must ensure that such variation is in writing and signed by you and on behalf of the Theatre before any Contract is made.
If any part of these terms and conditions are not enforceable then this will not affect the enforceability of any other part.
10. Safety and Enjoyment
10.1 The Theatre reserves the right to refuse admission and may request any Ticket holders to leave (taking any such appropriate action which may be necessary to enforce this right) before or during performances if it is necessary to do so. The Theatre may also, on certain occasions, have to conduct security searches to ensure your safety.
10.2 Every effort will be made by the Theatre to admit latecomers at a suitable break in the event or performance.
10.3 The Theatre does not permit glass containers to be brought into the auditorium.
10.4 Mobile phones, pagers and watches must be silenced before entering the auditorium.
10.5 To be admitted you must be in possession of a valid Ticket.
10.6 Strobe lighting, smoke effects and gunshots are sometimes used in productions.
10.7 Videoing, photographing or recording by any means is prohibited unless specifically announced as acceptable before or during the performance.
11. Governing Law
These terms and conditions and any Contract concluded incorporating these terms and conditions shall be governed by English Law and all disputes shall be submitted to the non-exclusive jurisdiction of the English Courts.
